What is a Probate Estate

A probate estate is all the assets a person owns at his or her death  that are subject to probate administration

Probate administration is the process of proving to a probate court that the will is genuine.

Understanding the Probate Process

We would like to help you understand how the probate process works in it’s simplest form.

These are the basic steps for setting an estate:

  • A person passes away
  • There is a petition for probate
  • Then it is decided who will be in charge of settling the estate. One of two things will happen:
    • If there is a will – the person named in the will is the Executor of the estate (“Testate”).
    • If there is no will – the court will appoint someone to act as the Administrator of the estate (“Intestate”). Typically this person is a family member.
  • The assets are sold to pay the creditors
  • Once the creditors are paid, the heirs receive their inheritance
  • The estate is closed

Will I Need a Probate Attorney?

In most cases, you will need a probate attorney for some if not all of the work involved with settling an estate depending on the complexity of the estate. There are many variables in individual estates.
